About EB-1C Visa

The EB-1C visa is a U.S. employment-based immigrant visa designed for multinational executives and managers who are being transferred from a foreign office to a U.S. office of the same company.

Unlike many employment-based visas, the EB-1C does not require labor certification (PERM), making it a more streamlined pathway to permanent residency for qualified applicants.

Successful applicants-and their spouses and unmarried children under 21-are granted U.S. Green Cards, allowing them to live and work permanently in the United States.

Key benefits

Direct path to permanent residency

Provides a Green Card without requiring temporary visa transitions.

No PERM labor certification required

Eliminates the need for labor market testing, speeding up the process.

Designed for senior leadership

Faster processing compared to other categories

As a First Preference visa, EB-1C often avoids long backlogs.

Family inclusion

Spouses and children under 21 receive derivative Green Cards.

Long-term flexibility in the U.S.

Once approved, you can continue leadership roles without immigration restrictions.

Eligibility

What USCIS Evaluates

  • The actual duties performed, not just the job description
  • Whether the role is truly executive or managerial in scope
  • The organizational structure of the company
  • The size and scale of operations
  • Whether the applicant is leading people or functions at a high level

Application process

Step 1: Confirm Eligibility

Ensure both the company and the applicant meet EB-1C requirements.

Step 2: Gather Supporting Evidence

Prepare documentation including organizational charts, employment records, proof of company relationship, and evidence of executive/managerial duties.

Step 3: File Form I-140

The U.S. employer files the immigrant petition on behalf of the applicant.

Step 4: Priority Date & Visa Availability

Track visa availability through the Visa Bulletin.

Step 5: Apply for Permanent Residency

Inside the U.S.: File Form I-485. Outside the U.S.: Complete DS-260.

Step 6: Biometrics, Interview & Decision

Complete required steps and receive final decision. If approved, the applicant and eligible family members receive Green Cards.

What Determines Success

Approval is not based solely on job titles.

1

The actual duties performed, not just the job description

2

Whether the role is truly executive or managerial in scope

3

The organizational structure of the company

4

The size and scale of operations

5

Whether the applicant is leading people or functions at a high level

Note: A common issue is applicants being labeled as 'managers' but performing operational or junior-level tasks.
